Did you try returning it? If that guitar showed up at my door, it would have gone right back out the door within a week or two. There is absolutely no reason you should have to have the frets leveled on a brand new guitar.
I bought it from Meestersparkle on ebay. He is a powrseller on ebay that sells alot of brand new caparisons. He had me take it to a tech that he knew personally in my area. The tech was baffled. Meestersparkle had me send the guitar back for a full refund. He is a stand up guy and I would do business with him again (not that I would buy another Caparison lol). It was obviously beyond his control that the guitar was built poorly. He did the right thing though and I didnt loose any money on it, only time and dissapointment.

In all fairness to Caparison, that sounds like it was exposed to some nasty environmental conditions, which will cause problems for any guitar that is not made out of carbon fiber. I would have had them send me a replacement first.

Meestursparkle is good dude. I got mine from him too, and it's awesome. Yours probably got exposed to some bad elements in the shipping from Japan. I can't blame you for not wanting to take the chance again though. That being said I paid about $1700 for my Horus and am super happy with it, but I definately wouldn't go $2200 or whatever for a Dell 7. I would definately go KXK first, and I LOVE Caparison.

I own a few, and I've gotta say that the TAT's are probably the best ones they make. Jackson soloist killer's, by far. The Angelus are very nice as well.
