My band kicked me out and screwed me out of $1365.63...
Yeah, they were getting pissed because I needed a few weekends off for my upcoming wedding and other events. Apparently my singer thinks I have an attitude problem because I bluntly point out when he does stupid shit. Regardless, their method of telling me I am out was to try and change the email and password on the band's myspace site. It was all linked to my email, so it backfired on them. I locked them out of the site, have the band PA, and have all the merch. They already put up a new myspace, and claim they will just make more merch. They also claim they will come with the police and receipts to get the PA. I may be out of money, so I am trying to sell the merch off to recover some of the costs. I initially put the production of the CD's on my credit and have been slowly paid back, but not enough obviously. They say they won't pay me now.
So, if you can help me out I would appreciate it. I have CD's for sale and shirts. I will include free stickers for everything. The CD is entitled "Thrill or Be Killed" and it has 14 tracks. If you buy it off of me I will give it to you for $5 shipped in the US. If you buy it off the site it is a bit more money, but I will be changing it soon. Its all connected to my paypal and email so it doesn't matter. We also have shirts that I will let go for $5 shipped in the US. If you guys could help me out, I would appreciate it. It does suck for you though. If i'm in a band I always try to at least be semi-friends with everyone. I don't know how you can play in a band that at any moment could turn around and pull some shit like this. |

Actually you could tell the cops at the front door that the guys trying to claim the PA made a group purchase with you on it and that you're contacting a lawyer to obtain money/merchandise still available to you.
Start checking out your state laws on property purchased like this. Hell, call the cops and see what they have to say. |

The police have no authority in this, since it is a civil matter, and will probably make it well known to your former band. While they often come out in the interest of mediating a situation before it can escalate to a domestic disturbance, they cannot force you to hand over the PA, no matter how many receipts someone has. Only a judge can decide that matter.
Remember, a band is a partnership, and therefore the situation is a case of disputed ownership. This is not a case of theft, and without evidence of wrong doing, giving an officer the probable cause he needs to make an arrest, there is nothing he can legally do in this situation. The police handle criminal matters only. For what it's worth, this is why it is important to draw up legal documentation for matters such as this. Division is now an LLC, and as such, we are all equal partners in the enterprise. Written right into the paperwork is a clause that dictates the forfeiture of all future interests, with the exception of royalties on album sales, for any party that leaves the partnership. All band purchases are made with a band account, and ownership remains with the band. So, if everyone puts in money for something, and then one person quits, tough shit for that one person. This is why you put things in writing. I would never just chip in to buy something without establishing legal, documented ownership of said purchase.
