what was supposed to be a great day, it turned bad when i unpacked my near mint esp/ltd static-600 and a 3" piece of the body landed on the floor!

a guy down on his luck had both the epi goth v ($400-$500) and a near mint esp/ltd wayne static sig. ($700-$900) on one auction for $675 + shipping. i was watching it and noticed no one had bought it. prob because he was new to ebay and did not have a good search title. he listed it as "2 guitars for 1 price". if he would have actually put what they were in the title he would have got alot of bids.
anyway i email him and offer $700. he says give me $20 more to help on shipping and i would also get the guitar stand in the pic, 2 nice straps and he would throw in an almost new boss super distortion pedal. im like cool.
since the auction ended he didnt want to relist and get more charges from ebay, we agree to do it thru paypal. a few days later the packages arrive. i see the damage & got nuts - the esp is why i bought it from him, the other stuff was just bonus.
so i call him and discuss things. he's like i cant give you your money back, i had to pay rent with it. paypal says since i did not go thru ebay it is not protected under their rules
-didnt know this, thought using paypal was coverage. they tell me i gotta got to ups. they have it under investigation and will determine if they are liable. waiting to hear back.......
has this happened to anyone else? been using paypal for years and have had no problems till now.
